Virtual Care Subscription & Service Agreement
Last Updated: August 27, 2026
This Virtual Care Subscription & Service Agreement (“Agreement”) is between CARING SENIOR SERVICE USA LIMITED (“Caring Senior Service,” “we,” “us,” or “our”) and the individual completing the purchase (“Customer,” “you,” or “your”).
If the Customer is purchasing Virtual Care for another individual (“Care Recipient”), the Customer represents that the Customer has permission and appropriate authority to arrange for installation and use of the Virtual Care service in the Care Recipient’s residence and to provide the contact information designated under this Agreement.
By completing your purchase and selecting the checkbox indicating your agreement to these terms, you agree to the following:
1. Virtual Care Service
Caring Senior Service will provide access to its Virtual Care service, which includes installation and use of Virtual Care technology in the Care Recipient’s residence.
Virtual Care is designed to provide an additional safety net by identifying certain events, changes in routine, and potential care concerns and providing related notifications and care insights.
The service may include:
- Installation of Virtual Care equipment;
- Technology-generated identification of certain potential care or safety concerns;
- Notifications to designated contacts when applicable;
- Monthly care insights or care summaries; and
- Care coordination or follow-up by Caring Senior Service when appropriate.
The Virtual Care equipment remains the property of Caring Senior Service or its technology provider and is provided to the Customer only for use while the subscription is active.
2. Virtual Care Is Not an Emergency Response System
Virtual Care is intended to supplement, not replace, appropriate personal care, medical care, supervision, or emergency services.
Virtual Care does not provide continuous live supervision of the Care Recipient and is not a substitute for calling 911 or another emergency response provider.
Technology-generated notifications and insights may not occur immediately. The system may fail to identify an event, may identify an event incorrectly, or may experience delays because of technology, connectivity, environmental conditions, system processing, equipment failure, or other circumstances.
Caring Senior Service does not guarantee that Virtual Care will detect every fall, call for help, medical event, change in condition, or other safety concern.
If the Customer, Care Recipient, or another person believes there is an immediate or life-threatening emergency, call 911 directly rather than relying upon Virtual Care.
3. Monthly Subscription and Recurring Payment Authorization
The monthly subscription fee is the amount displayed to you at checkout.
By completing your purchase, you authorize Caring Senior Service and its payment processor to charge the payment method you provide for:
- The initial monthly subscription fee; and
- The same monthly subscription fee automatically each month thereafter until the subscription is cancelled.
This is a month-to-month subscription. There is no long-term commitment.
Your payment method will generally be charged on or around the same date each month as your original purchase date.
The monthly subscription price will not be changed without advance notice to you.
If a payment cannot be processed, Caring Senior Service may contact you to obtain updated payment information and may suspend or discontinue the Virtual Care service for nonpayment.
4. Installation and Access
After enrollment, Caring Senior Service will contact you or the designated contact to arrange installation of the Virtual Care equipment.
The Customer and Care Recipient agree to provide Caring Senior Service with reasonable access to the residence for installation, maintenance, replacement, troubleshooting, and removal of the equipment.
The Customer agrees not to intentionally disable, alter, damage, relocate, remove, or interfere with the Virtual Care equipment without authorization from Caring Senior Service.
5. Emergency and Notification Contacts
During enrollment, you will be asked to identify one or more individuals Caring Senior Service may contact regarding potential care concerns, Virtual Care notifications, emergencies, equipment issues, or other matters relating to the service.
You authorize Caring Senior Service to communicate with these individuals by telephone, text message, email, or other reasonable means using the contact information you provide.
You are responsible for ensuring that the contact information is accurate and for notifying Caring Senior Service when a designated contact or their contact information changes.
If you provide another person’s contact information, you represent that you have permission to provide that information for purposes related to the Care Recipient’s Virtual Care service.
6. Monthly Care Summary
You will designate the individual or individuals who should receive the monthly Virtual Care care summary.
The monthly summary may contain information regarding patterns, changes, events, or potential care concerns identified through the Virtual Care technology.
You authorize Caring Senior Service to provide the monthly care summary to the individuals you designate.
You are responsible for notifying Caring Senior Service if you wish to change the recipient of the monthly summary.
7. In-Person Caregiver Response
Virtual Care does not include routine in-person caregiving services as part of the monthly subscription price.
If a Virtual Care notification or other situation results in a need for Caring Senior Service to provide an in-person caregiver response, any caregiver services provided will be billed separately at Caring Senior Service’s then-current standard hourly rate for caregiving services, subject to our normal billing practices and any required service documentation.
Caregiver availability is not guaranteed.
When circumstances reasonably indicate a potentially life-threatening emergency, Caring Senior Service may contact 911 or other emergency responders rather than dispatching a caregiver.
Before personal assistance or caregiving services are initiated, the Customer or Care Recipient may also be required to complete additional service agreements, care documentation, authorizations, or other paperwork required by Caring Senior Service or applicable law.
8. Cancellation
The Virtual Care subscription is month-to-month and may be cancelled at any time.
Cancellation may be requested by email to virtualcare@caringinc.com or by telephone at 210-227-9494.
Cancellation will stop future monthly subscription charges after the current paid monthly service period has ended.
Unless otherwise required by law, payments already made for the current monthly service period are not prorated or refunded.
Virtual Care service may continue through the end of the paid service period unless Caring Senior Service and the Customer agree to an earlier termination date.
After the subscription ends, Caring Senior Service will arrange to recover the Virtual Care equipment.
9. Virtual Care Equipment and $200 Device Charge
All Virtual Care equipment provided as part of the subscription remains the property of Caring Senior Service or its technology provider.
Upon cancellation or termination of the service, the Customer agrees to provide Caring Senior Service reasonable access to recover the equipment.
A $200 Device Charge may be assessed if:
- The Customer or Care Recipient refuses or fails to allow Caring Senior Service to recover the equipment after reasonable attempts to arrange retrieval;
- The equipment is lost or missing; or
- The equipment is damaged beyond ordinary wear and tear.
Before assessing the Device Charge, Caring Senior Service will make reasonable efforts to contact the Customer regarding retrieval or the condition of the equipment.
By accepting this Agreement, you authorize Caring Senior Service to charge the $200 Device Charge to the payment method on file if one of the circumstances above occurs.
Normal wear and tear will not result in a Device Charge.
10. Technology and Service Availability
Virtual Care depends upon technology and other systems that may occasionally be unavailable or experience interruptions.
Caring Senior Service does not guarantee uninterrupted availability of the Virtual Care technology.
Service interruptions may result from circumstances including equipment problems, internet or telecommunications failures, power outages, software issues, third-party technology providers, maintenance, environmental conditions, or circumstances outside Caring Senior Service’s reasonable control.
Caring Senior Service will make reasonable efforts to address known equipment or service issues.
11. Privacy
Information collected or generated through Virtual Care will be handled in accordance with Caring Senior Service’s applicable privacy practices and privacy policy.
Virtual Care uses technology to identify potential care and safety concerns and generate relevant insights. It is not intended to provide Caring Senior Service, family members, or other designated contacts with continuous live access to activity occurring inside the residence.
Additional information regarding privacy and the use of Virtual Care technology is available in our Privacy Policy.
12. Customer Responsibilities
The Customer agrees to provide accurate information during enrollment and to keep Caring Senior Service informed of changes that may affect the Virtual Care service.
This includes changes to the Care Recipient’s residence, designated emergency contacts, monthly report recipients, payment information, or circumstances that may interfere with the Virtual Care equipment.
The Customer and Care Recipient agree to provide reasonable cooperation when Caring Senior Service needs access to install, inspect, service, replace, or recover Virtual Care equipment.
13. Termination by Caring Senior Service
Caring Senior Service may terminate or suspend the Virtual Care service for reasons including nonpayment, misuse or intentional damage to the equipment, inability to safely or reasonably provide the service, inability to access equipment when necessary, or circumstances that materially interfere with delivery of the service.
If Caring Senior Service terminates the service, recurring subscription charges will stop following the applicable final service period.
The Customer remains responsible for charges incurred before termination and any applicable Device Charge.
14. Limitation of Service
Virtual Care is designed to provide additional information and support related to the Care Recipient’s safety and care needs. It cannot eliminate the risks associated with living independently, illness, injury, falls, changes in condition, or other emergencies.
No technology can identify or prevent every adverse event.
Nothing in this Agreement limits any rights or remedies that cannot legally be limited under applicable law.
15. Governing Law
This Agreement will be governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where federal law applies.
16. Electronic Agreement
You agree that your electronic acceptance of this Agreement has the same effect as signing a written agreement.
Electronic records relating to your enrollment, acceptance of these terms, subscription, payments, and cancellation may be maintained by Caring Senior Service as part of its business records.
17. Entire Agreement
This Agreement, together with the applicable Privacy Policy and any additional service agreements executed for in-person caregiving services, constitutes the agreement relating to the Virtual Care subscription.
If personal assistance or other home care services are provided, additional agreements and disclosures required for those services may apply.
